The Scene

According to its website, The Madera Board of Supervisors is the legislative and executive governing body of the Madera County government. Each of the five supervisorial districts of the County elects one supervisor.

Within limits prescribed by State law, the Board enacts ordinances and rules, determines County policy, supervises the activities of County departments, adopts an annual budget, and fixes salaries.

The Board meets regularly on the first three Tuesdays of each month and occasionally on Mondays in the Board Chambers of the County Government Center in Madera. On Tuesday, May. 10, 2022, the meeting was at 9:00 am.

California Highway Patrol (CHP) Lieutenant Commander in Madera Hector Madrigal introduced Christopher Albanese as the interim CHP Lieutenant Commander in the Oakhurst area. 

The Board (5-0) unanimously approved the following in the consent agenda, except item P.

A. 8502: Receipt of Unanticipated Revenue No. 21-128 for $5,000.00 derived from Animal Services-Miscellaneous Revenue to Special Department Expense for the Fiscal Year 2021-2022. 

B. 8483: Agreement with California Mental Health Services Authority for inpatient psychiatric concurrent review for $31,933.44 for Fiscal Years 2021-2024.

C. 8524: Agreement with California Mental Health Services Authority (CalMHSA), under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), to protect the privacy and protected health information.

D. 8536: Resolution approving guidelines for the Housing Rehabilitation Program and Homebuyer Acquisition Only/Acquisition with Rehabilitation Program.

L. 8526: Resolution authorizing the filing of applications with the federal transit administration, an operating administration of the United States Department of Transportation, for federal transportation assistance authorized by Chapter 53 of Title 49 of the United States Code and any other federal statutes administered by the federal transit administration. 

M. 8540: Resolution approving Amendment No. 1 to application for Transportation Development Act funds for the Fiscal Year 2021-2022 and authorizing the Chief of Development Services to execute and submit the TDA Amendment request to the Madera County Transportation Commission. 

N. 8528: Transfer of Appropriations No. 21-129 for $14,000.00 transfer from Road Fund – Land to Equipment/Furniture>$5,000.00 for the Fiscal Year 2021-2022. 

O. 8532: Agreement with Shaw Land Surveying & Real Estate Consulting for $200,000.00 per year for five years for Acting County Surveyor Services for Fiscal Years 2022-2027. 

P. 8481: Consideration of approval to add an Armored Vehicle to the County’s Fleet through the 1033 program. 

Q. 8525: Consideration of entering into an Agreement with Guardian RFID for $83,789.11 for an Inmate Management System for the SheriffCoroner’s Office – Jail Division, for one (1) year with the option to extend three (3) times for an additional one (1) year terms at the rate of $22,495.00 per year. 

R. 8530: Memorandum of Understanding (MOU) between Madera County Department of Social Services and Madera County Sheriff’s Office to support processing applications for public assistance benefits for Madera County inmates pre-release effective May 1, 2022, through June 30, 2023, with automatic renewals for successive one-year periods. 

S. 8480: Resolution approving the grant application and accepting the agreement with the Department of Conservation for an award under the 2022 Multi-Benefit Land Repurposing Program grant. 

T. 8472: Assignment Agreement between Tully & Young, Inc, and Zanjero, Inc. to provide consulting services to the Water and Natural Resources and Community and Economic Division Department effective July 1, 2020, through June 30, 2023, and authorize the Chairman to sign. 

U. 8518: Agreement with Leadership Counsel for Justice and Accountability for $24,301.00 to work together in the California Resilience Challenge (CRC) Grant for the Fairmead Groundwater Resilience Project and authorize the Chairman to sign. 

V. 8484: Agreement with Luhdorff & Scalmanini Consulting Engineers for $287,000.00 to evaluate Madera County drinking water districts and service areas.

6. f. 8430: The Board (5-0) approved the resolution approving the Property Tax Administration Costs & Fees for the Fiscal Year 2021-2022. 

6.g. 8467: The Board (5-0) approved the ordinance to enact Sections 11.04.245 through 11.04.248 of the Madera County Code about building addresses and waived the first reading set the second reading for May 17, 2022. 

6. h. 8455: The Board (5-0) approved the ordinance relating to various staff committees amending sections 17.72.030, 17.72.040, 17.72.050, 16.06.010, 16.06.020, 16.06.030, 16.06.040 and 16.06.050 and repealing Section 17.12.010 of the Madera County Code; and waive the first reading and set the second reading for May 17, 2022. 

6. i. 8548: The Board (5-0) approved Military Equipment Policy Ordinance and Madera County Sheriff’s Office Military Equipment Policy. 

1. Introduction of an Ordinance to add Section 2.31.040 to Chapter 2.31 of Title 2 of the Madera County Code about the Sheriff’s Office’s acquisition and use of “Military Equipment,” as defined in Assembly Bill (“AB”) 481; Waive the first reading and set the second reading for May 17, 2022. 

2. Discussion and consideration of approval of Madera County Sheriff’s Office Military Equipment Policy (§706) which fulfills the requirements established by AB 481.

The Board held public hearings on the following:

7.a. 8340: The Board (5-0) approved a Resolution approving the estimate of expenditures and deciding to levy and collect a special assessment for road maintenance purposes. 

There are 562 parcels within the Bass Lake Assessment District 89-1. The Engineer’s Report AD 91-1 (Bass Lake Lands) identifies the interior and exterior boundaries by geographical order of what is now known as “The Pines Tract” Bass Lake AD 89-1. 

The residential parcels identified by the official map of “The Pines Tract” are within AD 89-1 and charged the $100 annual road maintenance assessment. 

There are approximately 6.14 miles of roads within the District, with an annual average cost of $50,000.00 for routine maintenance, easements, and drainage systems. 

This sum is available in the District’s account. 

The Bass Lake Homeowners Association recommends approval of this budget, annual work program, and the proposed continuation of the assessment. 

Section 10100.8 of the California Streets & Highways Code requires said maintenance assessment be established annually on or before June 30th.

The annual assessment raises all funds for the operation of this Special District levied on each residential parcel. Total collections are approximately $56,200 per year. 

Phil Toller from the Department of Public Works clarified that road maintenance in Bass Lake includes patching, flood control, overlays, and signage. 

7.b. 8535: The Board (5-0) approved the Mitigated Negative Declaration (MND #2021-22) and Rezone (CZ #2021- 003) and waved the 2nd hearing. 

1. Hearing to consider a request to amend the General Plan under Section 65358 of the Government Code (GP #2021-005) from A (Agricultural) to VLDR (Very Low-Density Residential) Designation. Anthony L Machado Trust owns the property located on the east side of Road 14 between Avenue 24 and Avenue 23 (23710 Road 14) Chowchilla. Size: 8.5 acres. APN: 025-210-033, -042. 

2. Second Hearing for consideration to adopt an Ordinance for Rezone (CZ #2021-003) from ARE-40 (Agricultural Rural Exclusive 40 Acre) to RRS (Residential Rural Single Family) District for a portion of APN 025-210- 033 and a Rezone from RRS-10 (Residential Rural Single Family 10 Acre) to RRS (Residential Rural Single Family) District for a portion of APN 025-210-042. 

3. Discussion and consideration to adopt a Resolution approving a Mitigated Negative Declaration (MND #2021-22) concerning the proposed project in compliance with the California Environmental Quality Act (CEQA) provisions. 

The parcels are west of Road 14 between Avenue 24 and Avenue 23 1/2 (23710 Road 14) Chowchilla.

The application is a General Plan Amendment from A (Agricultural) to VLDR (Very Low-Density Residential) Designation and Rezone from ARE-40 (Agricultural Rural Exclusive 40 Acre) to RRS (Residential Rural Süngle Family) District for a portion of APN 025-210-033.

There is rezone from RRS-10 (Residential Rural Single Family 10 Acre) to RRS (Residential Rural Single Family) District for a portion of APN 025-210-042.

Staff prepared a Mitigated Negative Declaration, required under CEQA, and provided mitigation measures regarding aesthetics. 

The proposed project Area 1 consists of a 6.25-acre portion of APN 025-210-042, including a 1.5-acre residence site and a small pasture previously used as a personal/hobby pasture for the property owner. 

The private pasture area is a domestic well that provides potable water for the residence and three smaller homes located on the southeast corner of the adjoining APN 025-210-042. 

A proposed general plan amendment to VLDR (Very Low-Density Residential) and a rezone to RRS (Residential Rural Single Family) District.

The proposed project Area 2 includes approximately 2.25 acres of APN 025-210-042, which the project rezones to the RRS (Residential, Rural, Single Family) district. 

This parcel section includes three residences and abuts residential use to the north and commercial use to the south. 

The proposed general plan and zoning designations would allow a one-acre minimum parcel size of 1 acre.

Any future land division would require an additional environmental review process.

On December 7, 2021, the Planning Commission voted 5-0, recommending Project #2021-006, GP #2021-005, and Rezone #2021-003 subject to conditions and mitigation measures MND #2021-22.

Staff supports a recommendation of PRJ #2021-006, subject to conditions, and MND #2021-22. 

The pending legislation centered on the following: 

8.a. 8550: The Board (5-0) authorized the Chairman to sign a letter to support the application by the California Department of Transportation (Caltrans) and San Joaquin Joint Powers Authority (SJJPA) to the United States Department of Transportation 2022 Multimodal Projects Discretionary Grant (MPDG) competitive grant program for the Madera High-Speed Rail Station Project. 

8.b. 8552: The Board (5-0) authorized the Chairman to sign a letter to support the application by the San Joaquin Regional Rail Commission (SJRRC) to the United States Department of Transportation’s (USDOT) 2022 Multimodal Projects Discretionary Grant (MPDG) competitive grant program for the Union Pacific (Fresno Subdivision) Ceres to Turlock Double Tracking Project (Project).
