Here’s what you need to know:

  • District Attorney Sally O. Moreno updated the Board on lawsuits involving the California Department of Corrections and Rehabilitation (CDCR).

  • Oakhurst resident and Trash Advisory Group member Danny Metz urged the Board to pursue centralized sorting, which reduces trash generation “to the source.”

  • The Board unanimously voted Tom Wheeler as Chairman and Brett Frazier as Chairman Pro Tem for 2022.

The Scene

According to its website, The Madera Board of Supervisors is the legislative and executive governing body of the Madera County government. Each of the five supervisorial districts of the County elects one supervisor.

Within limits prescribed by State law, the Board enacts ordinances and rules, determines County policy, supervises the activities of County departments, adopts an annual budget, and fixes salaries.

The Board meets regularly the first three Tuesdays of each month and occasionally on Mondays in the Board Chambers of the County Government Center in Madera. On Tuesday, Jan. 4, 2022, the meeting was at 3:00 am.

Discussions/Actions

District Attorney Sally O. Moreno updated the Board on lawsuits involving the California Department of Corrections and Rehabilitation (CDCR).

Citing emergency legislation and Proposition 57, CDCR began granting non-violent offenders, including people convicted of human trafficking. 

Rather than the standard 50% credits, CDCR granted them ⅔ time credit. If an offender has a 10-year sentence, their average would be 5 years. Under the emergency legislation, CDCR attempted to reduce it to 3 ⅓ years. 

She added that the CDCR did this based on an unspecified emergency, especially overcrowding. Since 2016, California prisons have not been overcrowded. 

She received an injunction granting a temporary restraining order (TRO) along with district attorneys. 

Hence, CDCR, instead of releasing non-violent offenders who served a third of their sentence, is limited to forcing them to fill half of their sentence. The court will grant a  preliminary injunction if there is an indication of a successful lawsuit. 

Oakhurst resident and a Trash Advisory Group member Danny Metz urged the board to pursue centralized sorting, which reduces trash generation “to the source.” 

He insisted on the Board for a 12-month extension of the deadlines in SB 1383 regulations. Also, he recommends establishing a commission, which can develop a “long-range view” of waste management. 

Another Oakhurst resident and a member of the Trash Advisory Group, Sue O’Connor, suggested a single black container with commingled trash and organics, in addition to the blue container of recyclables.

She advocated for self-composting, self-hauling, shared service, and locally centralized composting. The plan would concern upgrading the Mammoth Recycling Facility and the North Fork Transfer Station Facility. 

Yosemite Sierra Visitors Bureau CEO Rhonda Salisbury said 2021 was a “good comeback year” for tourism.

Yosemite New Life Church Pastor Dale Wohlgemuth raised concerns about homeless encampments around the church property.

Oakhurst resident Marc Sobel urged the Board to accept the offer of the Trash Advisory Group. 

Madera County Chair for the California School Choice Initiative John Pero asked the Board to support the California Education Freedom Act (EFA). 

5. Reorganisation of the Board of Supervisors 

The Board unanimously voted Tom Wheeler as Chairman and Brett Frazier as Chairman Pro Tem for 2022. 

The board unanimously approved items A to P. Staff recommended moving item G in the Jan. 11 consent agenda. 

The Board discussed the following items:

A. Approval of the Regular Meeting Minutes for December 14, 2021. 

B. 7967: Agreement with Merced Behavioral Center to provide mental health residential care for Madera County Behavioral Health Services adult clients for the Fiscal Year 2021-2022. 

C. 8046: Agreement with Heritage Oaks Hospital in amounts outlined in Rate Agreement for psychiatric inpatient care for Madera County Behavioral Health Services clients for the Fiscal Year 2021- 2022.

D. 8065: Agreement (State Agreement No. 839-PEI2021-MC) with California Mental Health Services Authority for $62,515.20 for the participation in the Statewide Prevention and Early Intervention (PEI) program for the Fiscal Year 2021-2022. 

E. 8088: Agreement with Thomas Milam, MD, Inc., dba Iris Telehealth Medical Group to provide Telepsychiatry Services for Madera County residents for the Fiscal Year 2021-2022. 

F. 8076: Grant Agreement 7FG21072 with CalFire to award and provide funds under the CAL FIRE Rural Fire Capacity (RFC) grant program for 2021-2022. 

G. 8085: 2022 Holiday Schedule for Madera County Employees. 

H. 8092: Certification Statement regarding Composition of Local Planning Council (LPC) Membership.

I. 8093: Updated Madera County Local Child and Development Planning Council (LPC) Bylaws. 

J. 7793: Appointment of Don Zylstra to the Maintenance District 22A Oversight Committee. 

K. 8086: Receipt of Unanticipated Revenue No. 21-069 for $10,000.00 derived from Sheriff-Coroner’s – Misc Revenue to Equipment, Software Maintenance, and Office Expense for the Fiscal Year 2021-2022.

L. 8087: Receipt of Unanticipated Revenue No. 21-070 for $662,500.00 derived from Mono Wind – State-Other and Operating Transfers Into Professional Specialized for the Fiscal Year 2021- 2022. 

M. 8096: Amendment to MCC No. 10806B-C-2019 with Sierra Education and Research Institute in the amount of $56,000.00 amending the Term for Life Skill Group Curriculum to January 1, 2022, through December 31, 2023, with the option to extend for two (2) additional year terms. 

N. 8089: Agreement with Madera Rescue Mission Incorporated in the amount of $21,600.00 per year for one residual bed and accompanying services for a term ending June 30, 2026.

O. 8097: Appointed Joe Perez, Department of Rehabilitation (DOR), to the Workforce Development Board (WDB) of Madera County for a 3-year term ending January 4, 2025. 

P. 8064: Amendment to MCC No. 11492A-21 with Corona Environmental Consulting, LLC increasing compensation by $30,000.00 to an amount not to exceed $80,000.00 for water market strategy program. 

The public session centered on the following:

7.c. 8084: Discussion and consideration to adopt a Resolution providing Deputy Assessor-Real Property Brian Glover with Supplemental Pay for the performance of additional duties as Acting Assessor. 

Director of Human Resources Elba Gomez stated that the Department of Human Resources and County Counsel recommends a 40% supplemental pay for Deputy Assessor-Real Property Brian Glover.

The Board unanimously approves the supplemental pay. 

Lastly, the Board unanimously expressed support for the Yosemite Area Regional Transportation System (YARTS) grant.
